The Federal High Court, Awka Judicial Division presided over by His Lordship, Hon Justice Nganjiwa has dismissed the interlocutory application for an Order of Mandatory Injunction in favour of Chief Edozie Njoku
In an interview with journalists in his office, the Anambra State Secretary of the All Progressives Grand Alliance (APGA), in a ruling today 1st of July, 2021, the Court held that the reliefs sought by the applicant were substantially the same as the reliefs sought in the substantive suit.
Consequently, the court held that granting such application will prejudice the hearing of the substantive suit before it.
It would be recalled that Barr Sopulu Ezeonwuka had earlier approached the Federal High court, Awka Judicial Division vide Suit No. FHC/AWK/CS/35/2021 praying the Honourable Court to inter alia, recognize Chief Edozie Njoku as the National Chairman of APGA and to compel him to conduct primary election on behalf of APGA. Thus, the Court in a considered ruling has dismissed the application for lacking in merit.
According to the Anambra state Secretary of the party, Chief Tony Ifeanya, “…with the above development, Ozonkpu Dr Victor Ike Oye remains the National Chairman of APGA while Prof Charles Soludo remains the duly nominated APGA candidate for the Nov 6,2021 Anambra Governorship election.”8
The Motion for Joinder filed by Ozonkpu Dr Victor Ike Oye will be heard on July 7;2021 being the next adjourned date for further hearing of the matter.
This however contradicts the report making the rounds in the media that ‘Federal High Court sitting in Awka, the Anambra State capital, has declared Chief Edozie Njoku the National Chairman of the All Progressives Grand Alliance (APGA).
The court also ordered the Independent National Electoral Commission (INEC) to issue Chief Njoku with letter of recognition with immediate effect.
